401(k) Litigation and the Aftermath of Fee Disclosure
 
In this presentation, our speaker will discuss recent 401(k) plan litigation, including current court cases and facts.  The presentation will delve into the connection between the court cases and the new rules on fee disclosure: why we now have these extensive disclosure requirements and what fiduciaries need to do going forward (i.e., evaluating whether disclosures are adequate, updating disclosures when fees and options change, and dealing with providers who don't give adequate information.)
 
We are pleased to welcome James C. Paul, Esq., a partner with Ferenczy + Paul LLP, an employee benefits law firm. Mr. Paul heads up the Sacramento, California office. A benefits practitioner for more than twenty-four years, Mr. Paul provides practical and understandable guidance, advice, and support for employers, plan sponsors, and other clients. From 401(k) plan compliance, to executive deferred compensation, to compliance with COBRA and HIPAA privacy rules, he has done almost everything in the employee benefits arena. His experience includes counseling employers on design, compliance, and operation of qualified retirement plans, nonqualified deferred compensation plans, welfare plans, and stock based compensation plans. He also counsels employers on fiduciary issues and benefits issues in acquisitions, and has experience in pension and welfare benefits litigation, fiduciary litigation, and the operation of multi-employer/union trust funds.

 

Mr. Paul serves on the Board of Directors for the American Society of Pension Professionals and Actuaries (ASPPA) and is Co-Chair of the ASPPA Government Affairs Committee. In 2010, Mr. Paul’s peers elected him to membership in the American College of Employee Benefits Counsel, the highest honor awarded to ERISA lawyers.

This lunch meeting will be held at the DoubleTree Hotel, 7450 Hazard Center Drive, San Diego, California 92108. Doors open at 11:30 a.m. for registration and networking, and the presentation will run from noon to approximately 1:00 p.m.  The reservation deadline for this meeting is Wednesday, September 12.

We are continuing our free guest program!  San Diego Chapter members may bring a plan sponsor company employee as a free guest to this meeting.  We will accept a total of ten free guests per meeting; additional free guests will be given priority registration for the next meeting.  Each plan sponsor company may be a free guest only once, but you are welcome to bring additional employees as paid guests.
